How we handle your personal information, and the rights you have over it under POPIA.

Who we are

Luxury Living Design designs, builds, restores, repairs and re-upholsters custom furniture for homes and businesses. For the purposes of the Protection of Personal Information Act 4 of 2013 (POPIA), we are the responsible party for the personal information described in this policy.

What information we collect

We only collect what you choose to give us. When you complete a form on this website, we collect:

  • your name;
  • your email address;
  • your phone number;
  • the service you are enquiring about; and
  • the contents of your message.

Our forms are protected by Cloudflare Turnstile, which checks that a submission comes from a person rather than an automated script. As part of that check, and as part of ordinary web hosting, technical information such as your IP address and browser user-agent is processed. We do not use this information to build a profile of you.

If you contact us by phone, email or in person, or if we quote on and carry out work for you, we may also hold information relating to that work — for example a delivery address, site access details, or the specification of the piece being built or restored.

We do not knowingly collect special personal information as defined in POPIA, and we ask that you do not send us any through this website.

Why we collect it

We process your personal information in order to:

  • respond to your enquiry and answer your questions;
  • prepare and send you a quotation;
  • plan, carry out and deliver work you have commissioned;
  • keep a record of our correspondence with you; and
  • protect our website and forms from spam and abuse.

We do not sell your personal information, and we do not use it for automated decision-making.

By submitting a form on this website, you consent to us processing the information in that form for the purposes set out above. That consent is voluntary and you may withdraw it at any time by contacting us — although if you withdraw it while a project is in progress, we may not be able to continue that work.

Who we share it with

We do not sell, rent or trade your personal information. We do share it with a small number of service providers (operators, in POPIA terms) who process it on our behalf, strictly so that this website and our enquiry process can function:

  • Cloudflare — hosts this website and provides the Turnstile anti-spam check on our forms.
  • Amazon Web Services (Simple Email Service) — delivers form submissions to us by email.
  • Leads Hub — the enquiry management system operated by our web partner, Virtual Mart, where enquiries are recorded so that none are missed.

Some of these providers process information on servers outside South Africa. Where that happens, POPIA requires that the information receives a comparable level of protection; these providers operate under their own data protection commitments and contractual safeguards to that effect.

We may also disclose information where we are required to do so by law, or where it is necessary to establish, exercise or defend a legal claim.

How we keep it safe

We take reasonable, appropriate technical and organisational steps to protect your information against loss, damage and unauthorised access. This website is served over HTTPS, form submissions are transmitted encrypted, and access to enquiry records is limited to the people who need it in order to respond to you.

No method of transmission or storage is completely secure. If a security compromise affecting your personal information occurs, we will notify you and the Information Regulator as POPIA requires.

How long we keep it

We keep enquiries for as long as we need them for the purpose they were given, and thereafter only where the law requires it — for example, records relating to completed work and payments, which must be retained for tax and accounting purposes. Enquiries that do not lead to work are deleted once they are no longer of any use to us. You may ask us to delete your information sooner (see below).

Your rights under POPIA

You have the right to:

  • ask whether we hold personal information about you, and request a copy of it;
  • ask us to correct or update information that is inaccurate, irrelevant, excessive, misleading or out of date;
  • ask us to delete or destroy information we no longer have grounds to keep;
  • object to our processing of your information;
  • withdraw consent you previously gave; and
  • complain to the Information Regulator.

To exercise any of these rights, contact us using the details above. We may need to confirm your identity before we act on a request, and we will respond within a reasonable time.

Cookies and this website

This website does not use advertising cookies and does not run third-party analytics or tracking scripts. Cloudflare Turnstile may set a short-lived token in your browser as part of verifying that a form submission is genuine, and your browser stores your form details briefly so that we can show you a confirmation on the thank-you page. You can clear this at any time through your browser settings.

If we add analytics or marketing tools in future, we will update this policy before doing so.

Children

Our services are aimed at adults. We do not knowingly collect personal information about children without the consent of a competent person. If you believe a child has given us information, contact us and we will delete it.

Changes to this policy

We may update this policy from time to time to reflect changes in our practices or in the law. The current version, with its date, is always the one published on this page.
